When This Policy Applies

This is a Privacy Policy (as amended from time to time, the “Policy”) of TacBoard, LLC (d/b/a TacBoard or www.tacboard.com, and all subdomains) (“TacBoard,” “we,” “our,” or “us”). The Policy applies when you use our “Services” (defined herein). This Policy only applies to Services and not to any third-party websites, services or applications, even if they are accessible through our Services. What This Policy Explains

The Policy explains how TacBoard obtains, retains, discloses, transfers, disseminates, analyzes, and otherwise uses (“collect(s)”) information from you (or from others about you), and how we use or share such information. By using the Services, you understand that we may process your data, including personal information, as disclosed and provided for in this Policy. If you do not agree, please do not use the Services.

Our Services

TacBoard is an Internet-based website and SMS-based or MMS-based (text messaging) service that allows you (interchangeably, with and without others, either separately or collectively, “you” or “user”) and others to submit photos and messages to a private phone number for display on a centralized, privately hosted URL (a “Digital Canvas”) at a party or event, viewable by you and party or event guests, either in real time during the party or event, or at a later date (all of the foregoing, the “Services”).

When We Collect Information

We may collect information when you use the Services through our website, send photos or messages to a privately hosted number, or contact or communicate with us directly, by email, SMS, MMS, or otherwise. We may also collect information when third-parties provide us with information about you.

Your Consent

If you provide us with your telephone number, you agree that we can send SMS notifications to that number and understand and consent to data usage rates that may apply. By using the Services, you consent to us collecting your information as described this Policy and also in connection with the Services (as we provide them from time to time, which may differ from the Services we currently provide). In the ordinary course, we only collect the telephone number of the purchaser of a Digital Canvas. Any purchaser of a Digital Canvas will not be required, solely by reason of the purchase and use of the Digital Canvas to share his, her, or its phone number or contact information with anyone who posts images or text to the Digital Canvas.

Information We Collect From You

  (1) Basic account information

When you create or modify an account with us (such as when you sign up for the Services for a party or event and create/modify a Digital Canvas) we may ask you to provide certain personally identifiable information (“PII”), such as your name (although pseudonyms are allowed), an email address, a unique username that you request to be known as with respect to your account (a “handle”), a password for your account, and/or your telephone number (separately or collectively, “Basic Account Information”). You may edit your Basic Account Information at any time.

  (2) Additional information you provide

We may also collect other information, depending on the context. For example, to create and assign a Digital Canvas for your party or event, you may provide us information, such as a picture, short biography or information about the party or event, the party or event’s location, personal websites, or other information—all of which we may collect. The Services allow you (and others) to submit information, such as images and messages to your Digital Canvas, all of which are available to you and anyone with whom the Digital Canvas is shared, whether by you or someone else. We may collect any and all such information. Also, if you contact us via email or contact us in any other way, we may collect the information that you send us or share with us.

  (3) Payment Information

We may also collect information relating to the person or entity that is paying for the Services. This may include credit/debit card information, billing name, phone number, address, or other information that you may provide in the course of making an electronic payment (e.g. through PayPal).

  (4) Automatically collected information

We automatically collect some information when you use the Services. Some of this information may be the same or similar to the information identified above. This information also includes:

   (i) Device Information: Information about your computer, mobile, or other device, including its model number, operating system and version, mobile carrier, telephone number, browser type and language, and any unique device identifiers, such as the devices’ MAC address or IMEI.

   (ii) Location Information: Information about wireless networks or cell towers near your device, or the Internet Protocol (IP) address of your device(s).

   (iii) Information We Get From Cookies and Other Tracking Technologies: Information we get from cookies (session and persistent cookies) and similar technologies, such as web beacons, to collect data, such as data about how users engage with or use the Services, how you interact with or use the Services, aggregate usage by users (and, perhaps, users of other service providers) and web traffic routing in connection with our Services. Most Internet browsers automatically accept cookies. Please note some of the Services may not function properly if you disable cookies.

   (iv) Usage: Information about your use of the Services, such as the time, date, and location of your use, and information that you make publicly available, such as the information you submit while using the Services.

   (v) Log Data: Information we receive when you use the services like your IP address, browser type, operating system, browser history, location, mobile carrier, device information (including device and application IDs), search terms, and cookie information. We may also receive this information when you click on, view or interact with links on our Services, including any links to third-party websites or applications, or when you receive email notifications from us.

Google Analytics Disclosure

We may collect information about you that we obtain from other third parties. For example, we may obtain information through an analytics program, such as Google Analytics or similar programs. We may then combine any or all of this information with other information that we have collected from you or from other third parties.

How We Use Information We Collect

This is what we do and don’t do with information we collect about you:

  • We do not sell, rent, or trade your personal information with any other party (including third-party financial institutions) without your permission and consent or as otherwise required by law.
  • We may use your information to learn about your (and others’) use of the Services so that we try to improve the features and functions of the Services.
  • We may contact you to send you periodic messages, updates, or notifications regarding the Services or this Policy.
  • We may monitor and analyze trends and usage, and make inferences regarding the Services.
  • We may use your information to help prevent spam, fraud, or abuse by users of the Services.
  • We may use information to forecast trends, using algorithms or other methodologies.

How We Share Information We Collect

This is how we share information we collect:

  (1) Information We Share to Other Digital Canvas Users

We may share information to other users of your Digital Canvas through our Services. This information may include your name, your username, your handle, the name of the party or event, the event gallery or Digital Canvas’ unique phone number, the event gallery or Digital Canvas’ unique URL, and any other information that you display within your Digital Canvas, such as any biography or information about the specific party or event, any photos or messages, and any websites. This information will also include information you make available on the Digital Canvas, like images and messages.

  (2) Information we Share With Third Parties

We have business relationships with third parties that help us provide and improve the Services. We engage service providers to perform functions and provide services to us related to the Services. We may share information with such service providers. If we share PII with a service provider, we will take steps whenever practical to aggregate, anonymize, pseudo-anonymize or otherwise alter the PII such that it does not immediately identify you personally.

  (3) Law and Harm

We may collect your information even where this Policy otherwise prohibits us from collecting it if we believe such collection is reasonably necessary to comply with any law, regulation, legal process, or governmental request, or for any of the following purposes: to protect the safety of any person; to respond to fraud, security or technical issues; or to protect TacBoard’s rights or business interests. However, this right is not intended to limit your legal defenses or objections you may assert to prevent us from collecting your information for such purposes.

  (4) Business Transfers

If we are a party to a bankruptcy, merger, acquisition, reorganization, or sale of all or substantially all of our assets, your information may be sold or transferred as part of that transaction. This Policy will continue apply to your information transferred to the transferee, and will be subject to any subsequently permissible changes, revisions, or amendments.

Information We Keep or Delete

Your information, is not automatically deleted, including but not limited to images and text submitted for display on a Digital Canvas. We may retain information we collected in connection with your use of the Services, even after the end of your party or event. We may continue to collect your information until you request (at any time) that we stop collecting your information, including your Basic Account Information, by emailing us at [email protected]. Please allow us approximately 30 days to comply with your request. Note that your information may be deleted automatically after an extended time during which you do not use the Services.

Security

TacBoard will use commercially reasonable efforts to maintain the security and integrity of the information that we collect, including your PII. However, due to the inherent risk of data breaches, we are unable to guarantee the security of your information.

Third Party Companies Excluded from this Policy

We may provide you with links to or may connect you with other companies. Any information that you provide to an other company or institution, or information that is collected by that other company or institution, is not subject to this Policy whether or not we referred you to them (except as otherwise explicitly stated in this Policy). We recommend you carefully review the privacy policy for any company or institution that is linked to or connected from the Services (or with which you interact during any use of the Services).

Do-not-Track

TacBoard does not respond to “do-not-track” signals at this time. The Services will function even if “do-not-track” is enabled on the device being used for the Services. Accordingly, the website may continue to track your use of the Services.

International Visitors

The Services are hosted in the United States. If you are an international visitor, you should note that by providing your personal information, you are: (i) permitting the transfer of your personal information to the United States which may not have the same data protection laws as the country in which you reside; and (ii) permitting the use of your personal information in accordance with this Policy.

Changes to This Policy

We may change (or otherwise revise or amend) this Policy from time to time on and after the Effective Date. The current version of the Policy will govern our use of your information and is available for you to review at [tacboard.com]. If we change this Policy in any manner that we (in our sole discretion) determine is material, we will notify you by posting or publishing the new policy on our website. By continuing to access or use the Services after any changes become effective, you agree to be bound by the revised Policy.
